Provide a copy to tenants free of charge at the earliest opportunity — ideally before they commit to the tenancy.
Valid exemptions
Limited exemptions exist, including:
- Properties where all relevant improvements have been made and the rating remains below E
- Properties where improvements would devalue the property by more than 5%
- Short-term lets (under six months)
- Listed buildings (in some cases — seek advice)
Exemptions must be registered and are time-limited (typically five years).
Penalties
Local authorities can fine landlords up to £5,000 for renting a property below EPC E without a valid exemption. You also cannot serve a valid Section 21 notice without a current EPC.
